These Terms of Service (“Terms”) govern your use of websites, online stores, products, services, and related digital services operated by Binghamton Health Campaign, Inc. (“BHC,” “we,” “us,” or “our”), including the Confluence Running, Ruthie’s Run, and Lake Placid Running & Triathlon Company brands.
By accessing our website, creating an account, placing an order, or using our services, you agree to these Terms and to policies incorporated into them by reference.
Our ecommerce store is hosted using Shopify.
Eligibility and Lawful Use
You may use our services only for lawful purposes.
By placing an order, you represent that you have legal capacity to enter into the transaction or are acting with appropriate authorization.
You may not use our websites or services to violate any law, infringe another person's rights, transmit malicious code, interfere with site security, engage in fraud, scrape or misuse protected information, or otherwise interfere with normal operation of our services.
Products and Product Information
We make reasonable efforts to present product descriptions, images, colors, pricing, specifications, availability, and other information accurately.
Actual product appearance may vary because of photography, displays, manufacturer changes, or other factors.
Product information, availability, assortments, and pricing may change without notice.
We reserve the right to discontinue products and to limit quantities when reasonably necessary.
Pricing and Errors
We attempt to maintain accurate pricing and product information.
If a material pricing, inventory, product-description, discount, or technical error occurs, we may correct the error and, where appropriate, contact you regarding the order or cancel the affected transaction and return amounts already paid.
Nothing in this section limits rights provided by applicable law.
Orders
We reserve the right to accept, decline, limit, or cancel an order when reasonably necessary, including suspected fraud, payment issues, pricing or inventory errors, unauthorized resale activity, fulfillment limitations, or violations of these Terms.
If we cancel an order after payment has been collected, the applicable amount will be returned using the appropriate payment method.
Customers are responsible for providing accurate billing, shipping, contact, and account information.
Payment
Orders are subject to successful payment authorization.
Payments may be processed by Shopify, Shopify Payments, credit-card networks, banks, digital-wallet providers, or other third-party payment services.
Use of those services may also be subject to the provider's applicable terms.
Shipping and Delivery
Order processing, shipping options, international shipping, store pickup, customs responsibilities, and related matters are governed by our Shipping Policy.
Carrier transit times are generally estimates unless expressly stated otherwise.
Returns, Refunds, and Exchanges
Returns, refunds, and exchanges are governed by our Refund Policy and our Returns & Exchanges page.
In general, merchandise must remain brand new and be tried on only indoors on clean carpet to qualify for a refund to the original payment method.
Merchandise used beyond a carpet-only try-on may instead be eligible for an exchange under our Refund Policy.
Clearance and Final Sale merchandise is final sale except where applicable law requires otherwise.
If any summary in these Terms differs from the current Refund Policy, the Refund Policy controls.
Promotions, Discounts, and Loyalty Programs
Promotions, discount codes, loyalty benefits, gift-card offers, sweepstakes, and other special programs may be governed by additional terms disclosed with the applicable offer.
Promotions may have eligibility requirements, expiration dates, product exclusions, geographic restrictions, limits, or other conditions.
Unless otherwise stated or required by law, promotional offers cannot be combined and have no independent cash value.
Gift Cards and Store Credit
Gift cards and store credit are subject to applicable law and any terms provided when issued.
Gift cards and store credit are not redeemable for cash except where required by law.
Events, Registrations, and Services
Some events, races, programs, coaching services, classes, or other services offered or promoted by us may have separate registration terms, waivers, cancellation rules, transfer rules, refund policies, safety requirements, or participation agreements.
Those event- or service-specific terms apply to the applicable registration or service and will control if they conflict with these general Terms.
Third-Party Services and Links
Our services may integrate with or link to third-party platforms, including Shopify, payment providers, shipping carriers, event-registration systems, social networks, maps, review services, and other technology providers.
We do not control the independent policies, availability, or content of third-party services.
Use of a third-party service may be subject to that provider's own terms and privacy policy.

If you enroll in an SMS or messaging program, additional messaging terms may apply.

Intellectual Property
Unless otherwise indicated, our websites and their original text, graphics, logos, photographs, videos, design elements, software, and other content are owned by us or used with permission and are protected by applicable intellectual-property law.
You may use the site for ordinary personal shopping and informational purposes.
You may not reproduce, republish, distribute, commercially exploit, or create derivative uses of protected content without authorization, except as allowed by law.
Reviews, Comments, Photos, and Other Submissions
If you voluntarily submit a review, comment, photograph, testimonial, suggestion, or other content for publication, you represent that you have the right to provide that content and that it does not violate applicable law or another person's rights.
You grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, display, adapt, and distribute content you submit for publication in connection with our business, subject to applicable privacy law.
We may moderate or remove submitted content that violates these Terms, applicable law, or platform policies.

To the fullest extent permitted by applicable law, our websites and digital services are provided on an “as available” basis.
We do not guarantee that every digital service will always operate without interruption or error.
Nothing in these Terms excludes warranties, consumer protections, remedies, or other rights that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by applicable law, Binghamton Health Campaign, Inc. and its officers, employees, affiliates, agents, contractors, and service providers will not be liable for indirect, incidental, special, punitive, exemplary, or consequential damages arising solely from use of our website or services.

Customers may also have mandatory rights under the laws of the jurisdiction in which they reside.
